Im with Deano and Ligersaur on this one, love the occasional Domino's. Oh and very much with Robbrockley too, plenty of discussion and distaste, but very little offering or interest in offering up an alternative business.

Well to be fair to P1971 she said that is what she has been told by the owner, she is hardly going to have cast iron proof unless she is part of the deal, which clearly she is not.

Surely they would have needed to get planning permission for their delivery service - and I can't imagine the council agreeing to parking of scooters on that part of the road.

Durrr! Sorry, I was thinking of the wrong place but I have heard from another source that Dominos are negotiating on this one - and I saw surveyors in there last week.

Although this property has its own parking area at the rear for the scooters I believe there will still need to be a new planning application to change its use from a straightforward restaurant.

Indeed yes there will - from A3 to A5 (hot food takeaway) or mixed A3/A5 if they are maintaining a restaurant use (assuming the unit doesn't already have partial A5 status).

The relevant policy to consider will I think be DM policy 18, see page 55 of the DM policy document http://www.lewisham.gov.uk/myservices/pl...option.pdf

Thank you SimonK - very informative and interesting.

It states:-

'The Council will not grant planning permission for new hot food take-away shops that fall within 400 metres of the boundary of a primary or secondary school (the exclusion zone).'

Also, 'where there is no harm or loss of amenity to the living conditions of nearby residents, including that created by noise and disturbance from other users and their vehicles, smell, litter and unneighbourly opening hours.'

On the first point, we have Holy Trinity primary school within 200 metres and the front gates of Sydenham Girls at around 400 metres.

On the second point, there is an old converted church containing 5 flats within 5 metres of the parking space behind the restaurant - presumably where Dominos' scooter riders will be whizzing in and out until whatever hour in the evenings.

But maybe Dominos think they will be able to persuade the council that it was already trading as a takeaway; and get away with not having to make a new application for the A5 aspect?

Yes, the key question is whether it is already considered to be mixed A3/A5 use, though they would still need an application if they wanted to switch to pure A5.

My guess is that they wouldn't be taking it on if they didn't feel confident of getting it.

The existing use class is A3. This can be seen from a rejected application from 2010. Link to the application can be found at:

Based on the situation with the Old Bank, a planning application from A3 to A5 would be required particularly since Dominos does not include any A3 (restaurant) provision in it's units.

The change of planning use would probably be accepted (as it was on appeal for The Old Bank), nobody could reasonable say that changing this unit to A5 would have a significant adverse impact on the high street.

The issues of moped noise and parking, and the distance from a primary school could be interesting issues.

Amazing how long it has taken Dominos to find a third unsuitable location for their SE23 outlet!

I agree.

Regarding the schools though, was the 400 metre exclusion zone an adopted part of Lewisham's planning policy when Dominos originally applied in HOP?

This should be quite an interesting case.

Remembering of course that most are franchise owned, so this isn't Domino's finding locations, its franchisee's

Personally I would like one in the area, closer than Catford or Dulwich. Best deals are always collection. YUM! Thumbsup
