I think you know what it means Robin, and this is going to end up in the English Usage section.

It means there aren't some rapes that are 'more serious' than others, as Ken Clarke was said to have said. That doesn't mean to say that the law doesn't recognise that aggravating factors can result in a much longer sentences for one rape compared to the next (the point I think Clarke was trying to make).
